Title: Hot Topics in Ch. 7, 11 & 13 Bankruptcy

Summary: This course will give overviews of two hot areas in consumer practice, Chapter 13 practice and Fair Debt Collection Practices Act litigation. Since the 2005 Consumer Bankruptcy Law amendment, practice has radically changed and Chapter 7 cases have become much more difficult. The Chapter 13 segment will review changes under the new law, explore recent case law and simulate a mock Chapter 13 case. We will also analyze the FDCPA and discuss litigation tactics and claims valuation. The Chapter 11 portion of this course will present defending preference actions, including the impact of recent changes to the Bankruptcy Code and the ordinary course of business, new value, and other defenses. Also, the effect of the Code’s changes on small business debtors and creditors. Finally, the advantages, disadvantages, and methods of purchasing a distressed company inside versus outside of Chapter 11.
